How
do I request a fair hearing?
You
can request a fair hearing by writing to the:

You
can also request a hearing in person at the welfare office at 1220 W. Vliet
Street or FAX a hearing request to Madison at 608-264-9885.
When
can I request a fair hearing?
You
can request a fair hearing if:
Your Medicaid
has been denied or terminated.
You have
been denied a medical service.
A medical
service you were receiving has been stopped or reduced, and you disagree
with the decision.
Is
there a time limit for requesting a fair hearing?
You
have 45 days from the notice of denial or date of the termination
or reduction of your benefits to request a fair hearing. The request must
be received in Madison by the 45th day.
Note:
If you were not sent a notice of termination, reduction or denial, you
can appeal at any time.
Will
my benefits stop if I request a fair hearing?
If
you request a fair hearing before the date of termination of your Medicaid,
or before a medical service is reduced or terminated, your benefits or
services cannot be stopped until a hearing decision is issued. A hearing
decision must be issued within 90 days of your hearing request.
Example:
If you receive a notice telling you that your Medicaid case will close
on May 1, and you request a fair hearing before that date, your Medicaid
must continue until a hearing decision is issued. If you do not appeal
by May 1, your Medicaid will close on May 1, but you still have 45 days
from May 1 to appeal, or you lose your right to appeal. If you win your
fair hearing, the county will be ordered to open your case back to May
1.
